The Office of the City Attorney seeks a highly qualified, innovative, and community-oriented attorney who is interested in public service for the Housing Justice Initiative project (“Housing Justice Attorney”). Under the working title of Housing Justice Attorney, the position will be filled at the level of a Deputy City Attorney I or Deputy City Attorney II. This is a Grant Funded Limited Duration Appointment, funded for a maximum of three years from the Affirmative Litigation Funds that the City Attorney has allocated to pay the salary and benefits for the position. The position will be funded by Affirmative Litigation Funds in accord with the Council’s Fiscal Year 2019-2021 Biennial Budget Resolution No. 87759 C.M.S. The City Attorney has sole and absolute discretion to determine the allocation of the Affirmative Litigation Funds to pay for future affirmative litigation costs and fees, including but not limited to hiring in-house counsel.
The Housing Justice Attorney will report to the Chief Assistant City Attorney Maria Bee and/or to Deputy City Attorney Vs or Special Counsel that the Chief Assistant City Attorney may designate from time to time. This position will address the housing and related homelessness crisis in Oakland by assisting tenants and enforcing Oakland laws. The attorney will focus on tenant protection by performing litigation, policy work, and other actions. The position’s duties may include representing the City in state and federal court in partnership with other attorneys or independently and will provide significant litigation-related experience.
The Housing Justice attorney will represent the City of Oakland and also will work in collaboration with residents, non-profits, and other public agencies.
This position focuses on litigation, legislation and policy review related to tenant protection in Oakland’s diverse neighborhoods. Responsibilities include, but are not limited to: case evaluation, preparing pleadings, propounding and responding to discovery, taking and defending depositions, preparing for and representing the City in court, including settlement conferences, motions, and at trial. The incumbent will work under the supervision of a Senior Attorney.
We are seeking candidates who are highly motivated problem-solvers, able to communicate effectively with diverse communities, and who enjoy a high level of responsibility. Prior litigation experience, a background in housing law, and a demonstrated commitment to public interest law are desirable, as are superior legal research, writing, and oral argument skills. Foreign language skills, especially in Spanish, Cantonese or Mandarin, are a plus and may be a factor in selecting a candidate for the position.
The applicant must be a graduate of an accredited law school and a member in good standing of the California State Bar at the time of hire.
Grant Funded Limited Duration Appointment (GFLDA): The current vacant position is grant funded for a limited duration and shall not exceed three (3) years or when the funds are exhausted, whichever comes first.
The Deputy City Attorney I and Deputy City Attorney II are at-will positions, exempt from the provisions of the City of Oakland Civil Service Rules, per Charter Section 902.
This position may be filled at the Deputy City Attorney I or Deputy City Attorney II level, depending on the applicant’s depth of experience.
